This Week in the Supreme Court – week commencing 12th December 2022 – UKSCBlog

On Wednesday 14th December the Supreme Court will hand down judgment in the case of DB Symmetry Ltd and another v Swindon Borough Councilon appeal from [2020] EWCA Civ 1331. The Court was asked to consider if it is lawful for a planning authority, in granting planning permission for a development, to impose a planning condition that the developer will dedicate land within the development site to be a public highway. The hand-down will take place at 9:45 a.m. in Courtroom One.

Poland prepares changes to judicial law to unblock EU funds

WARSAW, Poland (AP) — Poland’s government has submitted to parliament a draft law that reverses key regulations on judicial responsibility that are an obstacle blocking the release of massive European pandemic recovery funds to the nation. Commentators say that the draft is a major step away from the policies that the right-wing government has been pursuing on the judiciary, trying to put it under political control. The draft published Wednesday removes the controversial powers of disciplinary judges from the Supreme Court, in practice voiding the authority of a professional responsibility chamber that is the main sticking point with Brussels. Poland’s prime minister said the proposed amendments are “good for Poland” and urged lawmakers to swiftly proceed with them.

Idaho Murders Update as 50 Search Warrants Obtained in Investigation

Latah County prosecutor Bill Thompson said that his office had obtained more than 50 search warrants for the investigation into the brutal murders of four University of Idaho college students.

Speaking to the local newspaper the Moscow-Pullman Daily NewsThompson said the Latah County Prosecutor’s Office is currently providing legal advice to law enforcement investigating the quadruple murder and working with investigators “as a team.”

According to Thompson, more than 50 search warrants have already been obtained in the ongoing investigation.

The prosecutor didn’t share any more details on the nature of the search warrants—whether they were for in-person searches or for requesting sensitive data from social media accounts, for example—as he stressed the importance of compromise between providing information to the public and not negatively impacting the case.

Shrewsbury Town Council owned a plot of land which was subject to a statutory trust arising either under section 10 of the Open Spaces Act 1906 or, impliedly, under the Public Health Act 1875. Pursuant to that trust, the town council had to allow the public to enjoy the land as an open space.
